Bermuda PIPA notice
Focus Media & Design operates from Bermuda and handles personal information in line with the Personal Information Protection Act 2016 (PIPA), alongside the privacy expectations of the agencies, business owners and their customers we work with.
Who is responsible
Focus Media & Design is the organisation responsible for the personal information collected through this website, our application forms, our booking calendar and our partner programme. Privacy questions, requests and complaints go to simone@focusmediadesign.com. We will acknowledge a request promptly and respond within the time allowed under PIPA.
Our PIPA commitments
We use personal information fairly and lawfully; we tell you why we are collecting it before or at the time of collection; we collect only what is proportionate to the purpose; we keep it accurate; we protect it with appropriate safeguards; we keep it only as long as the purpose or a legal obligation requires; and we remain accountable for information handled on our behalf by our service providers.
Information we collect and why
Application forms collect contact details, business details, project requirements and uploaded brand or reference files so we can assess fit and deliver the requested work. Bookings collect your name, email and notes so we can hold a call time. Partner accounts hold contact details, a referral code and referral outcomes so commissions can be tracked. Essential technical records, such as the submitting IP address, are kept to keep the website secure and to evidence consent.
Lawful use and consent
We rely on your consent when you submit a form, on the necessity of processing to enter into or perform a contract with you or your agency, and on our legitimate business interests in running, securing and improving the service. Optional uses, such as showing your website concept as social proof, are always separate, clearly labelled and switched off unless you choose them. You may withdraw consent for an optional use at any time.
Sensitive personal information
We do not ask for and do not want sensitive personal information as defined by PIPA, including information about race, ethnicity, health, biometrics, place of origin, political opinions, religious beliefs, sexual life or criminal records. Please do not include it in a form, an upload or a message.
Children
This is a business-to-business service and is not directed at children. We do not knowingly collect personal information from anyone under 14 without the consent of a parent or guardian. If we learn that we hold such information, we will delete it.
Disclosure and overseas transfer
We use trusted service providers to host the website and database, to store documents, to send email and to generate AI-assisted summaries and production plans. Some providers process information outside Bermuda. Before using an overseas provider we assess it and use contractual protections so that the information continues to receive a comparable level of protection, and we remain accountable for it under PIPA.
Artificial intelligence
We use AI tools to help summarise applications and draft website production plans. AI output is always reviewed by a person before it affects a decision, it is never the sole basis for refusing an application, and content submitted through these tools is not used to train public models.
Security and retention
Access to application data is limited to authorised Focus Media & Design team members. Uploaded files and generated PDFs are held in private storage reachable only through authenticated or single-purpose secure links. Records are kept while the relationship is active and afterwards only as long as our legal, accounting and dispute-resolution obligations require, then deleted or anonymised.
Your rights under PIPA
You may ask what personal information we hold about you and how it is used; ask for a copy; ask us to correct, block, erase or destroy information that is inaccurate or no longer needed; ask us to stop using it for direct marketing; and object to a use that is causing or is likely to cause you substantial damage or distress. Email simone@focusmediadesign.com and we will verify your identity before acting.
Breach notification
If a breach of security affects personal information and creates a real risk of serious harm, we will notify the Office of the Privacy Commissioner for Bermuda and the individuals affected without undue delay, and describe what happened and the steps we are taking.
Complaints
If you are not satisfied with our response, you may bring a complaint to the Office of the Privacy Commissioner for Bermuda. Contacting us first usually resolves matters faster.
